ORDINANCE 2025-22
CALENDAR YEAR 2025 ORDINANCE TO ESTABLISH A CAP BANK AND EXCEED THE MUNICIPAL BUDGET APPROPRIATION LIMITS (N.J.S.A. 40A: 4-45.14)
WHEREAS the Local Government Cap Law, N.J.S. 40A: 4-45.1 et seq., stipulates that, unless an ordinance permits an increase to 3.5% over the previous year’s final appropriations, a municipality must limit any increase in its annual budget to 2.5% throughout its preparation; and,
WHEREAS, N.J.S.A. 40A: 4-45.15a stipulates that a municipality may allocate the difference between its actual final appropriation and the 3.5% percentage rate as an exception to its final appropriations in any of the two years that follow, provided that the ordinance permits it to do so; and,
WHEREAS, in the interest of advancing the people’ health, safety, and welfare, the Township of Jackson’s Mayor & Council in the County of Ocean determines that it is both necessary and advisable to raise its CY 2025 budget by up to 3.5% over the previous year’s final appropriations; and,
WHEREAS, the Mayor and Council hereby conclude that it is both necessary and advisable to increase the budget for said year by 1%, or $480,256.79, over the increase in final appropriations otherwise allowed by the Local Government Cap Law; and,
ConsideringAny sum approved above that is not appropriated as part of the final budget will be kept as an exception to final appropriation in either of the next two years, according to the Mayor & Council’s decision.
THEREFORE BE IT ORDAINED, by the Township of Jackson’s Mayor and Council in the County of Ocean, with the affirmative consent of the majority of the full authorized membership of this governing body, that the Township of Jackson’s final appropriations in the CY 2025 budget year shall be increased by 1%, or $480,256.79, in accordance with this ordinance and N.J.S.A. 40A: 4-45.14, and that the Township of Jackson’s CY 2025 municipal budget be approved and adopted in accordance with this ordinance; and,
BE IT FURTHER ORDAINED that any funds permitted above that are not included in the final budget will be kept in either of the two years that follow as an exception to the final appropriation; and,
BE IT FURTHER ORDAINED that within five days of its introduction, a certified copy of this ordinance should be submitted to the Director of the Division of Local Government Services; and
BE IT FURTHER ORDAINED that within five days of this ordinance’s passage, a certified copy of the ordinance, including the recorded vote, must be filed with the aforementioned Director.

ORDINANCE 2025–2023
A JACKSON, COUNTY OF OCEAN, STATE OF NEW JERSEY, ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 380 OF THE TOWNSHIP CODE OF THE TOWNSHIP OF JACKSON, ENTITLED TAXICABS, LIMOUSINES, AND JITNEYS AS TO AMEND 380-33 ENTITLED, LICENSES,
Consequently, as directed by the Township’s governing body,
According to Jackson, Ocean County, New Jersey:
SECTION 1. Chapter 380, entitled Taxicabs, Limousines, and Jitneys, is revised and supplemented by this amendment to the Township Code of the Township of Jackson. Chapter 380-33, entitled Licenses, is altered to read as follows in its entirety:
The New Jersey State Police in the Department of Law and Public Safety or agents appointed by or under contract to the division must fingerprint all limousine license applicants in accordance with N.J.S.A. 48:16-22.3a. Additionally, the applicant must give written consent to the execution of a criminal history record background check, unless the applicant has already been fingerprinted and had a criminal history background check performed as part of an application for a commercial driver license, a passenger endorsement under a commercial driver license, or both, as required by N.J.S.A. 48:16-22.3a(b). The applicant is responsible for paying for both the background check and fingerprinting, including all processing and administration fees.
The Chief of Police, or, in his or her absence, the person in charge of said Police Department, shall promptly provide the Township Council with any information gathered from any source regarding said applicant or applicants after it has been received from the New Jersey State Police in the Department of Law and Public Safety or by agents contracted by or appointed by the division. According to N.J.S.A. 48:16-22.3a(d)(1), no applicant will be awarded a license until the Township Council is convinced that the applicant has no criminal history or reputation that would make them unfit to hold such a license.
The Clerk will grant a license in accordance with N.J.S.A. 48:16-17 when the necessary insurance policy has been filed and the $50 yearly license fee for each limousine service—plus $10 for each limousine covered by the applicable insurance policy—has been paid. The license must be purchased for the year that ends on March 31st. Along with the insurance details mandated by N.J.S.A. 48:16-17, the original license or a copy of it must be kept within the limousine and accessible for any law enforcement official to view.
SECTION 2. This section repeals all ordinances or portions of ordinances that conflict with it.
SECTION 3. Should a court of competent jurisdiction rule that any part of this Ordinance—whether it be a section, subsection, sentence, clause, phrase, or otherwise—is invalid or unconstitutional for any reason, that part will be considered a separate, distinct, and independent provision, and the validity of the remaining parts of this Ordinance will remain unaffected.
SECTION 4. As required by law, this ordinance will become operative following a second reading and publication.
